FACILITY USE RULES & REGULATIONS

1.   ALCOHOL is permitted in the Reception/Banquet Hall. The purchase of a Beer & Wine permit 

      from the Facility Manager is required.
2.   The Reception/Banquet Hall is a “SMOKE-FREE” facility. Smoking is prohibited in all areas of

      said building.
3.   LESSOR will furnish air conditioning, heating, and lighting which in its opinion is adequate. The

      failure to furnish air conditioning, heat, lights, or other service shall not abrogate this agreement

      and shall not entitle LESSEE to any rebate in fees.
4.   The sidewalks, passageways, loading area, exits and parking lot shall not be obstructed by

      LESSEE or any other person or property.
5.   No person shall be permitted to bring into said building or keep therein any equipment,

      furnishings, or other items for their use without permission from the Facility Manager.
6.   BOOKED HOURS: The hours you have contracted reflect your set-up time through your clean-up

      time. The Facility Manager must approve changes or additional hours.
7.   No nails, tacks, staples, or other attachment items shall be driven or hung into any portion of

      said building and no changes, alterations, repairs, painting, staining, or the doing of anything

      that will change the appearance or contours of said building will  be permitted.
8.   LESSEE shall be liable for any and all damage to the leased facility, including but not limited to

      any damages caused by LESSEE’S own acts or acts of any persons on the leased premises as a

      result of the event sponsored by the LESSEE. In addition the LESSEE shall indemnify and hold the

      Reception/Banquet Hall harmless for any and all damages to persons or property  arising from

      LESSEE’S operation or use of the leased facility.
9.   Nothing contained in this agreement shall prevent the LESSOR, its officers and/or authorized

      agents from removing any party or parties who, in the sole discretion of the LESSOR, its officers

      and/or authorized agent, is acting in a disruptive manner or causing an unnecessary risk of harm

      to persons or to property of the leased facility. LESSEE agrees to indemnify and hold harmless

      LESSOR for any and all liability arising from the removal of such person or persons. Not

      withstanding the forgoing provisions LESSEE acknowledges and agrees they are solely responsible

      for controlling the conduct of their guest using the leased facility.
10. LESSEE accepts the building in good order and repair and agrees to return it to LESSOR in the same

     condition, normal wear accepted.
11. LESSOR reserves the right, without notice, to cancel this lease at anytime whatsoever, if, in the

     determination of the LESSOR, cancellation is necessary to protect the health, welfare, morality, or

     safety of the public, or if the premises is used for any purpose other than that specified in this

     lease, or the number of guest exceed room size, or if LESSEE’S use constitutes a nuisance or is in

     any other way in violation of the laws or ordinances of the City of Marietta or the State of Georgia.

     In the event of a cancellation of this agreement, LESSEE shall have no claim of any character

     against LESSOR by reason of such cancellation.
12. Kitchen facilities include: Refrigerator/freezer, and microwave.
13.
A LOADING AREA is available for unloading/loading ONLY. After unloading is completed vehicles

       must be moved to designated parking area.
14. LESSEE is not authorized to remove furnishings or equipment owned by LESSOR from the buildings.
15. Any events that are booked after our 2am closing are responsible for a $50.00 per hour late

     supervisor fee, in addition to the normal rental charges from 12am until the premises are vacated

     by the responsible party and ALL their guests.
16. There is a MANDATORY cleanup charge for all events at the Reception/Banquet Hall. The fee is

     $200.00 and MUST be paid along with all other applicable charges, 30 days before said event is to

      take place.
17. CANCELLATION: In the event of a cancellation, there is a $250.00 non-refundable fee charged for

      ALL bookings. For the balance of all deposits, cancellation notice is as follows: 60 days prior to

      booked date is required in order to receive a full refund. Cancellations requested from 59-45 days

      will be penalized 25%; 44-30 days 50%; 29 – 0 days 100% of total amount paid.
18. REFUNDABLE DAMAGE DEPOSIT: The above regulations must be followed to assure the return of

      your refundable damage deposit.
